Civil Miscellaneous Petition No.14529 of 2016 a n d W.A.No.271 of 2012 S.Manikumar,J and N.Authinathan,J (Order of the Court was made by S.Manikumar,J) Material on record discloses that on 10/8/2016, when W.A.No.271 of 2012 was listed for hearing, learned counsel for the appellant was not present.

2. Learned Counsel for the second respondent seemed to have submitted that he was ready to argue. The writ appeal has been dismissed for default with costs. Seeking restoration of the same, C.M.P.No.14529 of 2016 has been filed.

3. We have gone through the averments made in the supporting affidavit and satisfied with the reasons assigned for absence. Mr.J.Sathyanarayana Prasad, learned counsel appearing for the second respondent has no objection for C.M.P.No.14529 of 2016 being ordered.

4. Placing on record the above, C.M.P.No.14529 of 2016 filed to set aside the order, dated 10/8/2016, is ordered. Consequently, W.A.No.271 of 2012 is restored to file.
