PRAYER:

Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus or any other writ or order or direction in the nature of writ, directing the 2nd respondent to call for the records, pertaining to order in Tha.Ma.No.29 of 2013 dated 17.09.2013 passed by the second respondent and quash the same as illegal, improper, arbitrary against the principles of natural justice and thereby directing the second respondent not to register any sale deed or document present either by respondents 3 to 6 or any other third parties in respect of the properties situated in S.No.92/12, 92/10, 93/4, 94/5, 92/14 at Thalavaipatti Village, Salem Taluk and District total to an extent of 35 1⁄2 cents of land.

O R D E R

This Writ Petition has been filed to direct the second respondent not to register any sale deed or document presented either by the respondents 3 to 6 or any other third parties in respect of the properties situated in S.No.92/12, 92/10, 93/4, 94/5, 92/14 at Thalavaipatti Village, Salem Taluk and District total to an extent of 35 1⁄2 cents of land.

2. Learned Special Government Pleader appearing for the official respondents submitted that sale deed has been registered even prior to filing of this writ petition and hence the prayer sought for by the petitioner become infructuous.

3. Learned Counsel for the petitioner also seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect in the petition.

4. In view of the above endorsement made by the learned counsel

for the petitioner, this petition is dismissed as withdrawn. No costs. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
