ORDER

The petitioner, who apprehends arrest for the alleged offence under 303(2), 326(a) of BNS r/w 21(1) of Mines and Minerals (Development and Regulation) Act in Cr.No.9 of 2026 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioner is that he is contractor for the railway project. After engaging the lorry, belongs to A2 and its driver, the petitioner is directed the driver to take sand from Kodaikal Mottur lake on the Sholingur to Wallajabad road. While transporting, the vehicle was intercepted by the respondent police and found that the vehicle was carrying three units of lake sand without valid permit and the same was seized by them and hence, case has been registered as against the petitioner. Subsequently, the present petition has been filed by the petitioner for seeking anticipatory bail.

The learned counsel appearing for the petitioner submitted that the petitioner is only a Technical Adviser in the private company, who has taken contract and he has not instructed the persons to take sand from the lake. He further submitted that the petitioner is ready to cooperate for the investigation and also ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side), appearing for the respondent police, reiterated the prosecution case and submitted that the petitioner is the main accused who directed the driver of the lorry to take 2/4

sand and he has also assisted the other persons to load the same and thereby directly involved in the offence. Hence, he vehemently opposed the grant of anticipatory bail.

5. Heard both sides and perused the materials available on record.

6. Considering the nature of allegations, the fact that the petitioner had illegally quarried the sand from the lake and thereby caused damage to the water bodies and ecology, I am not inclined to grant anticipatory bail to the petitioner.
