ORDER
The Writ Petition is filed directing the respondents to recognise the petitioner belonging to Hindu Vadugar Caste as a Telugu Linguistic Minority candidate and to accept the Minority Certificate issued by the competent Revenue Authority in her favour and consequently to consider and give admission to the petitioner to the Post Graduate Medical Course for the Academic Year 2025-26.

Upon considering the arguments made on behalf of the learned counsel for the petitioner and perusing the material records of the case and on hearing the learned counsel appearing on behalf of the respondents, the brief facts leading to the filing of the writ petition are that, the petitioner is competing in the Post Graduate admission to Medical Courses for the Academic Session 2025-2026. It is the case of the petitioner that she belongs to Hindu Vadugar Caste, which is a Telugu-speaking minority. It is the further case of the petitioner that all along, even in the previous years, the petitioner was permitted to take part in the counselling as a linguistic minority candidate. This year, the petitioner had simply uploaded the earlier certificate issued by the Zonal Deputy Tahsildar on 17.07.2024.
Upon scrutiny, it was found that the said certificate is not in accordance with Annexure-II in the current prospectus for the year 20252026. The current prospectus Annexure-II categorically states that the Tahsildar has to certify that the mother tongue of the petitioner is Telugu, however, upon perusing the certificate which is produced by the petitioner, it can be seen that the certificate only states that she knows to speak Telugu. Therefore, no exception whatsoever can be taken for rejecting the case of the petitioner for consideration under the Telugu Minority Quota. However, it can be seen that upon realising the mistake, the petitioner has again approached the Tahsildar to get the certificate in right format and the petitioner is now ready to produce the same.
3. It is seen that now only the stray round is remaining, the petitioner is
already participating in the Management Quota. Under the circumstances, considering the grievance of the petitioner cannot be retrospectively redressed by disturbing the allotment of seats already made, this Writ Petition is disposed on the following terms:
i) The petitioner shall participate in the Stray round under the Telugu Linguistic Minority Quota by producing the proper certificate as per AnnexureII. Upon production thereof, the petitioner will be allowed to participate in the above quota.
ii) If there is no vacancy in the said quota that is shown in the stray round or no allotment of seat on that quota to be made, it is open for the petitioner to participate as a general candidate in the Management Quota. iii) In case the petitioner is being considered under the Telugu Minority Quota, needless to mention that she will be placed in the bottom of the merit list.
4. Accordingly the writ petition stands disposed of. The authorities concerned shall act based on the web copy of the order without waiting for receipt of the certified copy of the order. No costs. Consequently, the connected miscellaneous petition is closed.
