ORDER : The Court Made the following order :- The petitioner who was arrested for the offence under Sections 8(c) r/w 20(b)(ii)(c) of NDPS Act and under Section 77 of the Juvenile Justice Act in Cr.No.247 of 2020 on the file of the respondent police, seeks bail.
2.It is the case of the prosecution that petitioner along with the other accused was found to be in possession of 74 Kgs. of Ganja. 3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and that he has been falsely implicated in this case. He would further submit that the charge sheet in this case was not filed within the time limit contemplated under the NDPS Act. 4.The learned Public Prosecutor (Pondy) would submit that though 74 Kgs. of contraband was seized from the accused, the https://hcservices.ecourts.gov.in/hcservices/
quantity of contraband involved in the case is above 75 Kgs. and further submitted that there is no previous case pending as against this petitioner.
5.Considering the quantity of contraband seized, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. -sd/- 15/04/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
