The petitioner/second accused who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 5(1), 6, 11(4), 12, 19 and 21(2) of Protection of Child from Sexual Offences Act, 2012 in Crime No.04 of 2024, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is working as correspondent in a School where the first accused is a teacher. The victim child is a student. The first accused is alleged to have committed the offences under Sections 5(1) and 6 of the POSCO Act as against the victim child. Complaint has been given to the petitioner but the petitioner brushed aside the complaint and did not take any action and thereafter, the victim child had called the child helpline and they rescued her. 3. It is seen that the petitioner had failed in his duty as correspondent of the school. The earlier application seeking anticipatory bail was dismissed as withdrawn. The statement recorded under Section 164(5) Cr.P.C., of the victim child had been perused and the victim child had very specifically named this petitioner as the person, to whom she went for help but the help was not given by the petitioner.

4. I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this petition stands dismissed.
