ORDER

The petitioner who was arrested and remanded to judicial custody on 04.01.2025 for the offence punishable under Section 8(c) r/w 20(b)(ii)(B) of NDPS Act and 25(1-A) of Arms Act in Crime No.8 of 2026 registered on the file of respondent police seeks bail. 1/4

2. The case of the prosecution is that the petitioner along with other accused was in possession of 3 kgs of ganja. Hence, the case.

3. The learned counsel for the petitioner submitted that the quantity seized from the petitioner is only a intermediate quantity and he is in judicial custody from 04.01.2025 and the petitioner is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate reiterated the prosecution case and submitted that there are seven previous cases pending against the petitioner which are similar in nature. Hence, he opposed to grant bail to the petitioner.

5. I have gone through the F.IR and it reveals that the seized quantity though not falls within the definition of commercial quantity, considering the fact that the petitioner is having seven previous cases including 4 NDPS cases, this Court is not inclined to grant bail. 2/4

6. Accordingly, this Criminal Original Petition is dismissed. 26.02.2026 smn To
