Mrs.K.Vasanthamala, learned Additional Government Pleader takes notice for the Respondent.

2. This Writ Petition is being disposed of at the stage of admission itself with the consent of the learned counsel for the Petitioner and the learned Government Advocate for the Respondent.

3. The petitioner is before this Court against the impugned order of the first respondent dated 31.12.2025, whereby the petitioner's appeal against order dated 14.07.2025 passed by the second respondent has been rejected on the ground of limitation on an account of failure on the part of the petitioner to deposit 10% of the disputed tax confirmed today, order dated 14.07.2025.

4. By the aforesaid Order in Original dated 14.07.2025, the following demand was confirmed against the petitioner. 2/5

5. It is noticed that the petitioner has voluntarily paid an amount of Rs.1,47,572) each towards CGST and SGST return on 03.06.2025. However, the Petitioner has not paid a sum of Rs.1,69,585/- balance amount towards cess. It is noticed that the Petitioner has replied to the Show Cause Notice in DRC 01 dated 28.05.2025 which culminated in the Impugned Order.

6. Considering the above payment, the impugned order is quashed and the case is remitted back to the first respondent to pass a fresh order on merits. Until then all recovery proceedings shall be kept in abeyance. 3/5
