Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondents to release the petitioner's Bolero pickup in bearing Registration No.KA52A6341 forthwith which was seized by the second respondent in Crime No.16 of 2022 on 01.02.2022, keeping under the custody of 1st respondent by considering the petitioner's representation dated 07.03.2022. ORDER
This writ petition has been filed for a mandamus seeking a direction to the respondents to consider the petitioner's representation dated 07.03.2022 to release the petitioner's Bolero pick up bearing Registration No.KA52A6341, which was seized and taken into custody by the second respondent in Crime No.16/2022.
2. The learned Government Advocate would submit that the aforementioned vehicle has been seized on account of illegal carrying on 1600 kgs of PDS rice. The said vehicle was seized on 01.02.2022. Now, final orders have been passed by the first respondent calling upon the petitioner to pay a fine amount of Rs.2,00,000/- for return of the seized vehicle to the petitioner.
3. The learned counsel on instructions would submit that the petitioner is willing to pay the fine amount and get his vehicle released.
4. After recording the rival submissions, the writ petition is disposed of, directing the petitioner to pay the fine amount of Rs.2,00,000/- ( Rupees Two Lakhs only) to the first respondent, within a period of one week from the date of receipt of a copy of this order. On receipt of the same, the first respondent shall release the aforementioned vehicle back to the petitioner forthwith. No costs.
