Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents 1 to 3 to issue suitable orders to enquire and cancel the entire transfer and posting of technical teachers as detailed table in the affidavit mentioned in para No.20 and to transfer and post the respective subject persons to the respective subject posts and to take action against the respondent No.5 for his illegal act by passing suitable orders.

ORDER

(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.R.Anandha Raj, learned counsel for the petitioner and Mr.C.Kathiravan, learned Special Government Pleader for respondents 1 to 4.

2. The petitioner is challenging the order of temporary transfers effectuated by the Commissioner of Employment and Training of the Instructors to the newly introduced Manufacturing Process Control and Automation trade in the upgraded Technology Centres.

3. It is the contention of the petitioner that the transfers are not in accordance with law and the qualification of persons.

4. Transfer is an incident of service. The persons who are transferred have not approached this Court.

5. In service jurisprudence, a public interest litigation should not be entertained, except a writ of quo warranto. If aggrieved person approaches this Court, we may consider the contentions.

6. The writ petition, as such, is dismissed. There shall be no order as to costs.
