[Made by S.M.SUBRAMANIAM, J.,] The present writ petition has been filed challenging the memo dated 19.07.2019 issued by the third respondent Tahsildar stating that a suit has Page Nos.2/5
been instituted challenging the notice issued under Section 7 of "the Tamil Nadu Land Encroachment Act, 1905 (Tamil Nadu Act III of 1905)" {hereinafter "1905 Act" for the sake of brevity}.
2. Under Section 14 of 1905 Act, the suit is expressly barred and it is also brought to the notice of this Court that the said suit has already been dismissed. Thus, there is no impediment for the authorities to proceed with enforcement action for removal of encroachments by following the procedure as contemplated under the 1905 Act.
3. The learned Additional Government Pleader, would submit that encroachments have already been identified by the competent authorities.
4. In view of the above submission, the official respondents are directed to complete the enforcement actions within a period of twelve weeks from the date of receipt of a copy of this order.
5. With the above direction, the Writ Petition stands disposed of. There shall be no order as to costs.
