This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.T.A.Srinivasan, the learned counsel for the Appellant and Mr.S.Senthil, the learned counsel for the respondents are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
COMMON TERMS OF SETTLEMENT The Appellant-D.Rajendran, originally filed a case before the Joint commissioner of Workmen Compensation, Coonoor, Nilgiris District seeking compensation of Rs.10,00,000/- for the injury sustained in his eye. As the prayer was rejected by the Joint Commissioner, the present appeal has been preferred by D.Rajendran before the Hon'ble High Court.
2. Both the parties having initiated negotiation successfully arrived at a settlement of all the issues arisen in this case and filed a terms of compromise before the lok adalat along with Demand draft for a sum of Rs.10,00,000/-. (Demand Draft No.827603 dated 10.12.2025) which is extracted as under:
3. Both the parties made a formal request to the lok adalat in terms of the above settlement.
4. As a result, the award is passed recording the terms of the compromise jointly placed by both the parties, the first respondent Rama Srinivasan, Proprietor, Srinivasa Corporation has issued a Demand Draft for a sum of Rs.10,00,000/- as agreed between the parties to the
Appellant, D.Rajendran, herein.
5. Both the parties have compromised the issues arisen in this case, and produced the terms of compromise before the lok adalat and the demand draft for a sum of Rs.10,00,000/- is handed over to the Appellant herein.
6. Consequently, the Civil Miscellaneous Appeal stands disposed of. The court fee paid by the appellant be refunded. D.Rajendran ... Appellant Rama Srinivasan ...1st Respondent This National Lok Adalat award is passed in terms of the above settlement.
The Court fee paid shall be refunded to the parties in the manner provided under the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994. Judge Member Member
