ORDER

The petitioner has filed this petition to set aside the judgement passed by

the learned Additional District and Sessions Judge, Dharmapuri in CA No.18/2022 dated 03.02.2024, confirmed the order dated 25.07.2022 in STC No.42/2020 on the file of the learned Judicial Magistrate FTC, Dharmapuri.

2. When the matter is taken up for hearing, the learned counsel on both sides appeared. The respondent also appeared along with his respective counsel. He submitted that he has been conducting the case from the year 2020 onwards and therefore insisted on interest for the entire amount.

3. The learned counsel for the petitioner/accused submitted that the petitioner had recently undergone surgery and was therefore unable to make the payment earlier. However, he is now ready to pay the balance amount of Rs.1,25,000/-, and in support of this, he has produced the demand draft.

4. It is noted that the respondent has already received Rs.1,25,000/-. The defacto complainant has sustained certain injuries and sought interest for the amount. Though he demanded 12% interest, this Court is inclined to restrict it to 6% for the entire amount of Rs. 2,50,000/-, which comes to Rs. 60,000/-.

5. The petitioner is directed to pay a sum of Rs.60,000/- towards interest within a period of eight weeks from the date of receipt of a copy of this order.

6. In view of the above, this Criminal Revision case is disposed of. If the petitioner fails to pay the amount, the respondent is at liberty to execute the order through the court of law.
