This petition has been filed to condone the delay of 115 days in filing the above Civil Miscellaneous Appeal.

2. Heard Mr.C. Munusamy, learned counsel for the petitioner. 3.Mr.M.J.Vijayaraghavan, learned counsel undertakes to file vakalat on behalf of the second respondent and he has no objection for allowing this petition.

4. Having regard to the reasons stated in the affidavit filed in support of this petition and this Court being satisfied with the same, this petition is allowed as prayed for. However, it is made clear that the appellant is not entitled for any interest for the delayed period if at all the compensation is going to be enhanced by this Court in the main C.M.A.

5. Registry is directed to number the main appeal, if it is otherwise in order and post the same for admission on 02.11.2021.

6. Registry is also directed to print the name of Mr.M.J.Vijayaraghavan as learned counsel for the respondent on the next hearing date.
