PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, direction to the respondents 1 and 2 to take action against respondent 3 based on complaint dated 11.02.2023 to take criminal action against the 3rd respondent and pass such other or further orders as this Court may deem fit and proper in the circumstances of this case and thus render justice.

O R D E R

The Writ Petition has been filed to direct the respondents 1 and 2 to take criminal action against respondent 3 based on complaint dated 11.02.2023.

2.It is the submission of the learned counsel for the petitioner that as per the certificate given by the Tahsildar, Wallajapattai, the property in the survey No.1538/1A to an extent of 0.0176.0 sq.meter and survey No.1539/1A to an extent of 0.0194.5 sq.meter belong to Ruthramuniappa, son of Malappa Chetty. However, the accused in this case created forged patta and sold the property. Therefore, the petitioner gave a complaint to the respondent Police on 11.02.2023. Since, no action is taken, this petition is filed.

3.The learned Government Advocate (Criminal side) submitted that based on the complaint given by the petitioner, enquiry is being conducted in C.S.R.No.203 of 2023. The copies of the documents are sought from SubRegistrar Office and Tahsildar office. Once the documents are received, the

case would be investigated and appropriate action would be taken. 4.Recording the submission of learned Government Advocate (Criminal side), this Court directs the second respondent to expedite enquiry in C.S.R.No.203 of 2023 and take appropriate action in the manner known to law within a period of six weeks from the date of receipt of copy of this order.

5.With the above direction and observation, this Writ Petition is disposed of. No costs.
