These applications are filed to implead A.James & A.John respectively as proposed defendants in C.S.No.494 of 2019. 2.

The main contention in the affidavit is that for effective adjudication on all the issues, the proposed parties being the brothers, their presence are required and they are also necessary and appropriate parties. Though this application is opposed by other side, this Court in similar applications filed in A.Nos.206 & 243 of 2020, passed a detailed order and held that impleading of the brother is necessary for the effective adjudication of all the questions and issues that may arise for consideration in the suit.

In such view of the above order, as the issue involved with regard to the family property, the presence of the brothers are absolutely necessary for the effective adjudication. Accordingly, these applications are ordered.
