PRAYER: Petition filed under Article 226 of the Constitution of India praying to issue a writ of certiorarified mandamus to call for the records in impugned order made in Na.Ka.No.69/Aa/2012 dated 06.02.2012 on the filed of the Third Respondent herein and quash the same as illegal and direct the respondents to conduct Public auction of fishing right of petitiner and other members of Kudavasal Local Co-operative Society, Koradachery, Thiruvarur District in accordance with law.

ORDER

This writ petition has been filed challenging the impugned order made in Na.Ka.No.69/Aa/2012 dated 06.02.2012 on the file of the Third Respondent.

2. It is represented by the learned counsel for the petitioner, on instructions, that the petitioner is satisfied, if G.O.Ms.No.332 Animal Husbandry and Fisheries dated 19.11.1993 is followed in letter and spirit.

3. Mr.L.P.Shanmuga Sundaram, learned Special Government Pleader appearing for the second and third respondents, after referring to paragraph 6 of the counter affidavit filed by the second respondent has also agreed that G.O.Ms.No.332 Animal Husbandry and Fisheries dated 19.11.1993 will be followed in letter and spirit.

4. Accordingly, this writ petition is disposed of with a direction to the second and third respondents to follow G.O.Ms.No.332 Animal Husbandry and Fisheries dated 19.11.1993 in letter and spirit while awarding fishing rights to the cooperative societies.
