This Criminal Original Petition is filed under Section 528 of BNSS to call for the records of FIR in Crime No.482 of 2025 dated 08.10.2025 on the file of 1st respondent herein and quash the same so far as petitioners are concerned.

ORDER
The Criminal Original Petition has been filed to quash the FIR in Crime No.482 of 2025 dated 08.10.2025 the file of 1st respondent herein insofar as petitioners are concerned.
2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the first respondent.
3. The case of the prosecution that on 08.10.2025 at about 10:54 a.m., while the 1st respondent was present in the police station, more than 50 persons allegedly formed an unlawful assembly and conducted a two-wheeler rally carrying black flags, thereby staging a protest and allegedly threatening the 1st
respondent. It is further alleged that the petitioner herein entered the police station and questioned the 1st respondent regarding the registration of the FIR in Crime No. 480 of 2025 dated 06.10.2025, obstructed him in the discharge of his official duties. On the basis of the said allegations, a complaint has been lodged against the petitioner and others for offences under Sections 191(2), 329(3), 132, and 351(2) of the Bharatiya Nyaya Sanhita, 2023, in Crime No. 482 of 2025.

Learned counsel appearing for the petitioners submitted that the facts of the instant case are similar to the facts of the cases in Jeevanandham and others vs. The Inspector of Police, Velayuthampalayam Police Station, Karur District, reported in (2018) 2 LW (Crl) 606), Sri Raja vs Inspector of Police, Sivakasi Town Police Station Virudhunagar District and others (Crl.O.P(MD) No.7922 of 2019, decided on 30.08.2019), and Ki.Ve.Ponnaiyan and others Vs. The State Rep. by The Inspector of Police and another, in Crl.O.P. No.134 of 2021 dated 22.08.2022, in which the proceedings were quashed. Hence, he prayed to quash the proceedings pending against the petitioners.
5. Learned Additional Public Prosecutor appearing for the respondent Police submitted that the present case was registered due to the protest
conducted without obtaining permission. He also endorsed the submission of the learned counsel for the petitioners that the facts of the instant case are akin to the facts in the aforesaid cases.

Considering the submissions made and upon perusal of the materials available on record, this Court is of the opinion that the above said decisions would apply on all fours to the present case and that no useful purpose will be served by keeping the proceedings pending and the same is liable to be quashed.
7. Accordingly, the Criminal Original Petition stands allowed and the First Information Report in Crime No.482 of 2025 on the file of the first respondent Police is hereby quashed as against the petitioners.
