Ramaiah v. Chinnasamy (Died)

CMP.Nos.5567 & 5568 of 2025in S.A.Nos.188 & 189 of 2019 T.V.THAMILSELVI, J.

These petitions have been filed to implead the respondents 5 to 11 as the respondents 5 to 11 in the Second Appeals and to rank them as R5 to R11.

2. The learned counsel appearing for the petitioner would submit that the proposed respondents are co-sharers of the suit property and they had been omitted to be including in the suit and as they are necessary parties for proper adjudication of the Second Appeals, they have to be impleaded in these Second Appeals.

3. The learned counsel appearing for the respondents would object these petitions stating that if the proposed respondents are impleaded, their rights will be affected.

4. Considering the submissions of both sides and without prejudice to the rights of the respondents, these petitions is Ordered.

5. The registry is directed to carry out necessary amendments and post the Second Appeals on 13.03.2026.
