ORDER : The Court Made the following order :- The petitioner herein apprehends arrest for the offences under Sections 294(b), 324, 448 & 506(ii) of IPC in Crime No.140 of 2022 is before this Court.

On reading of the FIR, it appears that on 21.02.2022, there was a dispute between the defacto complainant and the petitioner herein regarding harbingering the murder case. Since the defacto complainant tried to escape from the assault, the accused attacked in the back of his neck threatening that he will be done away soon. https://hcservices.ecourts.gov.in/hcservices/

Since the petitioner has fled from the scene of occurrence, this Court, on reading the FIR and the manner in which the attack has occurred, is of the view that the enmity between the rowdy elements had led to the current occurrence. If the petitioner is granted anticipatory bail, there is a possibility of re occurrence of the offence and threat to the life of the defacto complainant. Hence, the Criminal Original Petition is dismissed.
