In the present case, the writ petition was disposed of and the petitioner has not paid the Court Fee as ordered by this Court.
2. The learned counsel for the petitioner states that the petitioner will remit the Court Fee, within a period of one week.
3. The Registry of the High Court brought to the notice of this Court that the Court Fees as ordered by the Courts in respect of Joint Together Petitions, are not being paid by the petitioners. Since the main writ petition is numbered prior to payment of required Court Fee for all the petitioners, the Registry finds it difficult to monitor the Court Fees to be paid. The Courts are ordering notice to the respondents even before payment of required Court Fees and few writ
petitions are disposed of at the admission stage with a direction to the petitioners to pay separate Court Fee in respect of all the petitioners. In such circumstances, the Court Fees are not paid and the Registry is unable to recover the Court Fees. Unless the Court Fee is recovered, the copy of the judgment/order cannot be issued to be parties. The only condition precedent for receiving the judgment/order copy is to pay the Court Fee in full.
4. However, the parties are taking the order copies from the High Court Website and therefore, many such petitioners are not even submitting copy application for certified copies. The situation is causing inconvenience to the the Registry and they are not in a position to recover the Court Fee from the parties and there is a possibility of audit objections.
5. The situation prevailing in this regard is to be considered and appropriate decisions are to be taken for remedial
measures.
6. The Registry is directed to place this order before the Hon'ble The Chief Justice for necessary actions. 08-09-2023 Svn
