Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the second respondent to pull down/demolish the dangerous and dilapidated building in the premises bearing No.39/1-11, G.P Road, Chennai - 600 002, belonging to the third respondent.

The petitioner has come forward with the present writ petition seeking a writ of mandamus, directing the second respondent to pull down/demolish the dangerous and dilapidated building in the premises bearing No.39/1-11, G.P Road, Chennai - 600 002, belonging to the third respondent.

2. Heard the learned counsel for the petitioner and the learned counsels appearing for the respondents and perused the materials available on record.

3. According to the petitioner, the building in question is in a dilapidated condition and despite representations to the respondents, no action was taken. Hence the present writ petition.

4. The learned Standing Counsel appearing for the second respondent would submit that the Regional Deputy Commissioner (North), Greater Chennai Corporation, Zone V, has already issued a notice to the third respondent under Section 258, Madras City Municipal Corporation Act.

5. In the light of the above facts and submissions, this Court is of the opinion that, no further adjudication is required in this matter. This Court directs that the Regional Deputy Commissioner(North), Greater Chennai Corporation, Zone V, shall take follow up action and pass appropriate orders on merits and in accordance with law, within a period of three months, from the date of receipt of a copy of this order.
