These petitions are filed (i) to permit the petitioner to bring the legal heirs of deceased first respondent, namely Rathinam, as respondents 5 to 9 (ii) to condone the delay of 769 days in filing the LR petition to bring the legal heirs of deceased first respondent, namely Rathinam, as respondents 5 to 9 (iii) to bring on record the fifth to ninth respondents as legal representatives of the deceased first respondent namely Rathinam, and set aside the abatement caused due to the death of the first respondent and also condone the delay of 769 days in seeking the abetment caused due to the death of the first respondent, respectively. 2.The learned counsel for the respondents did not raise any serious objection and this Court is satisfied with the reasons assigned in the affidavit filed in support of these petitions. Hence, these petitions are allowed.

3.The Registry is directed to carryout necessary amendments in the Second Appeal No.983 of 2009 and list the matter for final hearing after four weeks.
