Respondents [P2 and P3 substitted as Legal heirs of deceased sole Petitioner vide Order dated 25.11.2022 made in WMP No.29964 of 2022 in W.P.No.2058 of 2018] Prayer : Writ Petition filed Under Article 226 of the Constitution of India, to issue a writ of Certiorarified Mandamus, calling for the records comprised in Ref:ZOC/PA/PC-WP/2017/63 dated 15.04.2017 on the file of the 4th respondent through which the order dated 15.04.2017 passed by the respondent/competent authority was communicated and a consequential direction directing the respondents to appoint her son C.Sushanth in the respondent Bank on the ground of compassionate appointment.

ORDER

This writ petition had been filed to call for the records comprised in Ref:ZOC/PA/PC-WP/2017/63 dated 15.04.2017 on the file of the 4th respondent through which the order dated 15.04.2017 passed by the respondent/competent authority was communicated and a consequential direction directing the respondents to appoint her son C.Sushanth in the respondent Bank on the ground of compassionate appointment.

2.The learned counsel for the petitioner made a submission that the original petitioner Smt.S.Shanta Kumari, wife of the deceased employee also expired. The eldest son of the deceased employee Mr.C.Sushanth is serving in IT Industry. This being the factum, the scheme of compassionate appointment cannot be extended in favour of the family of the deceased employee. However, the petitioners are at liberty to approach the respondents for any other benefits due to them including the ex gratia, if they are otherwise eligible as per terms and conditions. In the event of submitting any such application by the petitioners, the respondents shall consider the same and take a decision, as expeditiously as possible. 3/6
