ORDER

This Writ Petition has been filed challenging the online rejection order of st respondent, rejecting the application submitted by the petitioner on the 1 23.12.2024 for issuance of legal heirship certificate.

2. Heard Mr.P.Saravanan, learned counsel appearing on behalf of the petitioner and Mr.R.Neelakandan, learned Additional Advocate General appearing on behalf of the respondents.

3. The 1 st respondent has rejected the application mainly on the ground that the deceased died in the year 1980 and it is very difficult to find out the legal heirs at such length of time.

4. The death certificate of Arumugam, who is the father of the petitioner is available. He died on 03.05.1980. The specific case of the petitioner is that he died leaving behind his wife, two daughters and the petitioner, who is the st respondent by conducting an son. This fact can be easily ascertained by the 1 st respondent as legal heirship enquiry. Ultimately, what is given by the 1 certificate is only in the nature of the relationship certificate and nothing more.

5. In the light of the above discussion, online rejection order of the 1 st st respondent to respondent is quashed and there shall be a direction to the 1 conduct an enquiry and issue legal heirship certificate within a period of six (6) weeks from the date of receipt of a copy of this order.

6. This Writ Petition is allowed in the above terms. No costs. Consequently, the connected miscellaneous petition is closed. 28-07-2025 dsa Index:Yes/No Speaking/Non-speaking order
