Crl.OP.No.7521 of 2022 T.V.THAMILSELVI,J Both the petitioner and the defacto complainant appeared before this Court along with their counsel.
2.While granting an order of interim bail, the petitioner agreed to pay an interim maintenance of Rs.7,000/- per month to the child. Now the learned counsel for the defacto complainant submitted that she is proposed to move an appropriate forum to obtain maintenance and to initiate divorce proceedings.
3.Taking into consideration the facts and circumstances of the case, this Court already granted interim bail to the petitioner on 27.07.2022 and the same is confirmed.
4.As per the Joint Memo of Compromise filed by both sides, the petitioner already handed over the belongings, jewels, other articles and certificates to the defacto complainant. While passing that order, this Court had directed the petitioner to pay a sum of Rs.7,000/- per month as interim maintenance to the child and the same shall be continued to be paid till the order is passed by the appropriate forum with regard to the maintenance. As per the earlier order passed by this Court, the defacto complainant 1/3
already agreed to visit the child by the petitioner herein on alternate Fridays and Saturdays of Every English Calender Month and the same shall be continued. For other remedies, they have to workout their remedy before the appropriate Forum.
5.Today when the matter is taken up for hearing, the petitioner submits that his aged parents also want to see the grand child at the time of visitation right given to the petitioner herein. The defacto complainant/mother of the child also submits that she has no objection for the child being visited by the parents of the petitioner during the visitation period without causing any annoyance to her.
6.In view of the above, it is open to the parents of the petitioner to see the child during the visitation period without causing any annoyance to the defacto complainant. Accordingly, this Criminal Original Petition is disposed of. The joint memo of compromise dated 27.07.2022 shall form part of the order.
