ORDER

The petitioner who was arrested and remanded to judicial custody on 12.01.2026 for the offence punishable under Sections 140(2) of BNS @ 140(2), 191, 192(2) & 204 of NSS, 2023 in Crime No.16 of 2026 registered on the file of respondent police seeks bail.

2. The case of the prosecution is that the petitioner joined hands with 1/4

other accused and abducted the victim who is a real estate broker. It is alleged that the victim is a real estate broker and the petitioner has taken him to a unknown place and threatened him and transferred a sum of Rs.1,300/- via g-pay and thereafter escaped from the scene of occurrence. Hence the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and he is only present in the scene of occurrence and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is in Judicial custody from 12.01.2026 and is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate reiterated the prosecution case and submitted that CCTV footage reveals that the petitioner has threatened the victim and transferred the money to him phone via g-pay. He further submitted that there are 25 previous cases pending against the petitioner. Hence, he opposed to grant bail to the petitioner. 2/4

5. Considering the submissions made by the learned Government Advocate and the manner in which the occurrence has taken place and the bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
