This second appeal was already allowed by this Court on 05.07.2011. At the time of arguments, no one appeared on behalf of the respondent. As such exparte decree and judgment were passed Now, this application has been filed by the respondent to condone the delay in filing the petition to set aside the exparte decree and judgment dated 05.07.2011 passed in the main second appeal with a delay of 1936 days.
2.The learned counsel for the appellant also submitted that already on the basis of the above judgment and decree, the possession of the suit schedule property was also taken.
3.On perusal of affidavit, this Court also finds no sufficient reasons to condone the delay in setting aside the exparte decree and judgment dated 05.07.2011.
