Respondents Contempt petition filed under section 11 of the Contempt of Courts Act to punish the 1st, 2nd and 3rd respondents herein for having committed contempt by wilfully disobeying the orders of this Court dated 04.11.2015 made in Cont.P.No.14/2015.

ORDER

[Order of the Court was made by M.SATHYANARAYANAN] It is brought to the knowledge of this Court that the 3rd respondent in the writ petition [WP.No.4833/2013], viz., V.Shanmugam, filed a revision before the Director of Town and Country Planning, Chennai-2, and it was dismissed and aggrieved by the same, he filed a Special Revision under section 80-A of the Town and Country Planning Act, 1971, before the Secretary to Government, Housing and Urban Development Department, Fort St George, Chennai-600 009 and the same is pending. The learned counsel for the petitioner would submit that the Appellate Authority may also put the petitioner herein and give a disposal of the revision in accordance with law.

The Court heard the submissions of Mr.A.N.Thambidurai, learned Special Government Pleader appearing for the respondents and perused the materials placed before it.

Accordingly, the Secretary to Government, Government of Tamil Nadu, Housing and Urban Development Department, Fort St. George, Secretariat, Chennai-600009, is directed to put the petitioner on notice also and thereafter, dispose of the special revision petition filed by the 3rd respondent in WP.No.4833/2013 on merits and in accordance with law and pass appropriate orders as expeditiously as possible and communicate the decision taken, to the 3rd respondent and the writ petitioner. In the result, the contempt petition is closed subject to the above observation and direction.
