When the matter is taken up, Ms.Kavya, learned counsel representing on behalf of learned counsel on record for plaintiff / respondent submitted that the respondent / plaintiff has no objection for condoning the delay and receiving the written statement. It appears that the 4th defendant has not entered appearance sofar. Because of non-availability of the written statement of D1 to D3, this case is pending. Now that this application is filed for condoning the delay to receive the written statement. To decide the matter on merits, the receipt of written statement of D1 to D3 is necessary. In the circumstances stated in the affidavit and also that the respondent / plaintiff has no objection for allowing this application, this application is allowed. Written statements of D1 to D3 is ordered to be received. The Registry is directed to verify as to whether D4 was served and put up a note on 22.11.2022 with regard to the same.
