This application has been filed seeking to condone delay of 8 days in filing the written statement.
2.The said application has been filed by the 1st defendant in the suit. 3.In the affidavit filed in support of the application, it had been stated that the 1st defendant had been travelling frequently between Londan and Delhi and did not have any time to spare for this suit in Chennai. But, he must also realize that as a 1st defendant, he is answerable to the averments made in the plaint, failing which, it could also be presumed that he admits to such averments made in the plaint.
4.But at any rate, he has filed the written statement, but with delay of eight days.
5.Heard the learned counsel for the petitioner. 6.Taking all the factors into consideration, the delay is condoned. This application is allowed. The Registry to take the written statement filed by D1 and D2 on file.
