ORDER

This petition has been filed to call for the records pertaining to the case in Spl.C.C.No.17 of 2019 on the file of the Hon'ble Additional Mahila Court, (Fast Track Court) Namakkal and quash the same as far as the petitioner is concerned.

The learned Counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Without any base, the first respondent police registered a case in Crime No.9 of 2019 for the offences under Sections 6 r/w 5(1) of POSCO Act and 376 IPC, as against the petitioner and the same has been taken cognizance in Spl.C.C.No.17 of 2019 on the file of the Additional Mahila Court, (Fast Track Court) Namakkal. Hence he prayed to quash the same.

The learned Additional Public Prosecutor would submit that already NBW is pending against the petitioner as such he is not entitled to any relief as prayed for in this petition.

Heard Mr.L.C.Vasudevan, learned counsel appearing for the petitioner and Mr.M.Mohamed Riyaz, learned Additional Public Prosecutor appearing for the first respondent.

5. In view of the submissions of the learned Additional Public Prosecutor, this criminal original petition is dismissed. Consequently, connected miscellaneous petitions are also closed.
