Mr.B.Nedunchezhiyan, learned standing counsel takes notice for the respondents. By consent of the parties, the main writ petition itself is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for a mandamus directing the first respondent to pass orders on the representation dated 05.04.2017 wherein and whereby, he sought for considering his claim to run the TASMAC Shop No.9083 situated at Nandiambakkam, Minjur, by accepting the renewal amount.
3. It is seen that the licence issued to the Bar attached to the said shop in favour of a third party was cancelled and thereafter the respondents have not come forward to issue the licence by inviting tenders. Therefore, the petitioner seems to have made the above said representation for allotting the Bar in his favour. I do not think that the petitioner can seek for such allotment by making an application without participating in the tender process, as and when the same is resorted to by the respondents. Needless to say that the allotment of Bar licence cannot be done based on an application. Therefore, it is for the respondents to invite tenders by issuing appropriate notification and as and when any such notification is issued, it is open to the petitioner to participate in such process. When such being the fact, a direction can not be issued to the respondents to consider the representation of the petitioner, as sought for in the writ petition. This writ petition is disposed of, with the above observations. No costs.
