ORDER : The Court Made the following order :- Apprehending arrest at the hands of the respondent police for alleged offences punishable under sections 147, 148, 294(b), 324 and 506(ii) of IPC and Section 3(1) of Tamil Nadu Public Property (Prevention of Damage and Loss) Act, 1990 in Cr.No.56/2020, the petitioner has come forward with this petition seeking anticipatory bail.

The case of the prosecution is that due to previous enmity, the petitioner along with four other persons went to the house of the defacto complainant and attacked him with 'Sick' on his left leg and also criminally intimidated him. 3.

The learned Counsel for the petitioner submitted that the petitioner herein is the 4th accused and in respect of the coaccused, bail have already been granted by this Court. As far as this petitioner is concerned, no specific overt act was alleged against him. Therefore, the benefit of bail granted to co-accused should also be extended to him.

Having regard to the nature of the allegation levelled against the petitioner and more particularly, the fact that the co-accused have already been granted bail by this Court, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned District Munsif-cum-Judicial Magistrate, Needamangalam, on his executing a bond for a sum of Rs.5,000/- (Rupees five thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police for interrogation as and when required. -sd/- 18/03/2020 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
