Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the first respondent to consider the petitioner's representation dated 15.12.2021 along with the reminder dated 04.02.2022 regarding the consideration for further promotion to the petitioner, by revising the performance appraisal ratings of the petitioner and grant him the same with all attendant benefits.

O R D E R

By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed for issuance of a Writ of Mandamus to direct the first respondent to consider the petitioner's representation dated 15.12.2021 and grant promotion, by revising the performance appraisal ratings of the petitioner with all attendant benefits.

3. The case of the petitioner in brief:

The petitioner had joined as Officer Trainee in the Indian Oil Corporation Limited on 09.03.1987. Subsequently, he got admission to do Ph.D. in IIT Madras and he was granted https://hcservices.ecourts.gov.in/hcservices/

study leave initially for two years from July 2017 to June 2018 and thereafter, it was extended upto April 2021, during Covid pandemic. He rejoined service in April 2021 and during his study period, he was not paid pay. Further, he was denied promotion by the respondents and the petitioner remain in the same Grade since 2012.

Though the petitioner gave representation dated 05.12.2021 and reminder dated 04.02.2022, it was not considered. Hence this writ petition.

4. The learned counsel appearing for the respondents submitted that the representations of the petitioner would be considered and appropriate orders would be passed by the authorities concerned, in accordance with law.

5. Inview of the above submission and considering the limited scope of prayer and to meet the ends of justice, without expressing any opinion on merits, this court is inclined to pass the following order.

i) The first respondent is directed to consider the representation of the petitioner dated 15.12.2021 and the reminder dated 04.02.2022 and to pass order in accordance with law, on its own merits, within a period of four weeks from the date of receipt of a copy of this order.

6. With the above directions, this writ petition is disposed of. No costs.
