O R D E R

The petitioner/accused, who apprehends arrest pursuant to an Non Bailable Warrant issued by the learned District Munisf cum Judicial Magistrate, Kodavasal on 12.11.2024, seeks anticipatory bail.

2. The learned counsel for the petitioner submitted that the petitioner was arrested and released on bail in Crime No.30 of 2019; that later charge sheet was filed in STC.7/2024 before the learned District Munisf cum Judicial Magistrate, Kodavasal; that due to his medical conditions, he was unable to appear; and that NBW was issued on 12.11.2024.

3. The learned Government Advocate (Crl.Side) submitted that though summons were served on the petitioner, he did not appear and hence, opposed for grant of anticipatory bail.

4. Heard both sides.

5. Considering the rival submissions, this Court is of the view that the anticipatory bail cannot be granted. However, the petitioner is at liberty to 2/4

approach the learned District Munisf cum Judicial Magistrate, Kodavasal for recall of warrant, which shall be considered by the learned magistrate on the same day on merits and in accordance with the law.
