Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents to assign the said lands in favour of the petitioner society and consequently to grant patta for the said lands in the name of the petitioner society as per petitioner representation dated 14.02.2024.

O R D E R

This writ petition has been filed for a direction to the respondents to assign lands in favour of the petitioner society and consequently for a direction to grant patta for the said lands in the name of the petitioner society as per petitioner's representation dated 14.02.2024.

2. The grievance of the petitioner is that he has given a representation dated 14.02.2024 for re-classification and assignment of lands, however, no orders have been passed. The learned Special Government Pleader, appearing Page 2/5

for the respondents would submit that orders will be passed by the first respondent on its own merits.

3. Considering the limited scope of the relief sought, there shall be a direction to the first respondent to consider the representation of the petitioner dated 14.02.2024 on its own merits and strictly in accordance with law, by giving an opportunity of being heard to the petitioner, and dispose of the same within a period of two months from the date of receipt of a copy of this order. If the first respondent finds that the land is really a water body, the authorities have to ensure that such water body is not disturbed.

4. With the above direction, the writ petition is disposed of. However, there is no order as to costs. Consequently, the connected writ miscellaneous petition is closed.
