Writ Petition is filed seeking to issue a Writ of Certiorari to call for the records and quash the proceeding of the 1st respondent in Rc.No.2370/2016/C2 dated 18.05.2016.

2. The petitioner challenges the proceedings initiated U/s. 78 of the The Hindu Religious and Charitable Endowments Act.

3. In the last hearing counsel sought time to get instructions whether they are willing to pay the arrears. Today, the learned counsel seeks to withdraw the Writ Petition.

4. Writ Petition is dismissed as withdrawn. However, the respondents are at liberty to recover the amount as per law.

5. Since the challenge is for initiating the proceedings U/s. 78 of the Act, the Joint Commissioner is directed to dispose of the Section 78
