ORDER

This writ petition has been filed by Mr.V.Palanisamy seeking a writ of mandamus directing the District Collector, Coimbatore and the Executive Officer, Village Panchyat, Arasur, Sulur Panchayat Union, Coimbatore / respondent 1 and 2 to complete the metal road work in the place of old cart road at Survey No.356/1, Arasur Village, Sulur Taluk at an early date to facilitate all the villagers and farmers.

2. It is the claim of the petitioner that there is a cart road in S.No.356/1 in Arasur Panchayat, Sulur Panchayat union area and the same has been used by the villagers and farmers including the petitioner for several decades. But in view of the

fact that as the said cart road was not properly laid, during rainy season, it causes huge problem to the road users. As a result, the cart and the vehicles are not able to ply on the said road. Therefore, all the farmers gave a representation to the Village Administrative Officer to measure and note down the cart road in Survey No.356/1. On the basis of the said representation, the VAO and other Surveyors visited the village road and marked the cart road in S.R.No.356/1. A report was also prepared on the same day and the copy thereto is also filed in the present writ petition.

Even though the Government of Tamil Nadu has also sanctioned sufficient fund to develop the cart road into pucca metal road (Double layer) through 14th Finance Committee Aid and the District Collector having initiated proceedings to replace the cart road into metal road by proceedings, dated 18.09.2015 bearing Na.Ka.No.3063 /2015/A2, the respondents 1 and 2 have not even proceeded with the laying of the new road. Therefore, the petitioner has sought for direction to complete the metal road work in the said survey number expeditiously for the benefits of the villagers and farmers.

Today, Mr.V.Selvaraj, learned Additional Government Pleader appearing for the second respondent on receipt of written instructions from the Special Officer, Arasur Panchayat would submit that the pucca metal road would be laid in the cart road and the work also will be completed on or before 10.02.2017. Placing on record the letter, dated 19.01.2017 addressed to the Additional Government Pleader, the respondents are directed to complete the work as undertaken before this Court in their proceedings, dated 19.01.2017. With the above observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
