ORDER

This petition has been filed by the petitioner seeking a direction to the second respondent to take appropriate action against the third respondent based on the petitioner's complaint dated 22.01.2026 and conclude the enquiry in connection with C.S.R.No.47 of 2026 on the file of the second respondent within a time frame.

2.The contention of the learned counsel for petitioner is that the petitioner's company M/s.Bharat Balancing Weightss & Co. is engaged in the manufacture of vehicle spare parts. The petitioner's company approached the third respondent to replace its old machine and to purchase a new one. The third respondent estimated the value of the new machine as Rs.19.5 Lakhs and fixed the value of old machine at Rs.12,00,000/- and instructed the petitioner's company to pay the difference amount of Rs.7.5 Lakhs. Though the petitioner's company paid the amount of Rs.7.5 Lakhs, the third respondent evaded to hand over the new machine. After repeated demand for 2/5

returning the deposited amount of Rs.7.5 Lakhs, the third respondent paid only Rs.1.5 Lakhs. Whenever the petitioner approached the third respondent to get back the balance amount, he threatened the petitioner with criminal intimidation. Hence, the petitioner lodged a complaint on 24.11.2025 with the first respondent and the same was forwarded to the second respondent. Though CSR No.47 of 2026 assigned on the petitioner's complaint, so far, no action has been taken by the second respondent. Hence, the present petition is filed.

3.The learned Additional Public Prosecutor produced a letter stating that no further action needs to be taken on the petitioner's complaint. 4.Considering the submissions made and on perusal of the materials, it is seen that on the complaint of the petitioner, CSR No.47 of 2026 assigned on 22.01.2026. Thereafter no enquiry conducted with the third respondent. The petitioner paid an amount of Rs.7.5 Lakhs to the third respondent through bank. From the letter it is seen that no steps were taken to cause any enquiry with the third respondent. In view of the same, the respondent police is directed to cause enquiry with the third respondent and to conclude the CSR proceedings and to take appropriate action, if required. The entire exercise to be completed by 30.04.2026.
