Consistently there is no representation on behalf of the appellant. When the matter was listed for hearing on 04.10.2017, there was no representation on behalf of the appellant, hence, the matter was adjourned to next week. Thereafter, when the matter was listed for hearing on 11.10.2017, even on that day, there was no representation on either side. Hence, this court had directed the Registry to list the matter on 23.10.2017 under the caption for dismissal. Today also, there is no representation on behalf of the appellant. In these circumstances, this court left with no other option except to dismiss the Civil Miscellaneous Appeal for non prosecution. Accordingly, the Civil Miscellaneous Appeal is dismissed for non prosecution No costs.
