Judgment (Judgment of the Court was delivered by S.M.Subramaniam J.) The facts in brief in the present lis would show that the writ petitioner/appellant was appointed as Junior Assistant in Forest Department in the year 1989. He was missing from the year 2006 onwards and a complaint was given by his wife. A case was registered in Cr.No.164/2008 on the file of Saidapet Police Station. The appellant was not traceable and it was informed to the wife of the appellant. After a lapse of about six years, the appellant joined his family in the year 2012. Thereafter, he submitted a representation to the department to reinstate him. In the meanwhile, departmental disciplinary proceedings was initiated and it was found that the appellant remained unauthorisedly absent for about 5 years and 9 months. Thus, an order of removal was passed by the Joint Director in the office of the Principal Chief Conservator of Forests. The order of removal passed by the original authority was confirmed by the appellate authority in the appeal filed by the appellant.

The facts as stated above would be sufficient to form an opinion that the appellant deserted the job and remained unauthorisedly absent for about 5 years and 9 months and disciplinary proceedings was initiated in compliance with the rules of natural justice and he was removed from service. The said factual position was considered by the writ Court in the context of the Disciplinary and Appeal Rules. Thus, the appellant has not established any

acceptable grounds for the purpose of entertaining the present intra Court Appeal. Consequently, the Writ Appeal stands dismissed. No costs. (S.M.S.,J.) (N.S.,J.) 03-06-2026 Index: Yes/No Speaking/Non-speaking order VSI To
