ORDER

Alleging that the order of this Court dated 14.10.2025 passed in W.P.No.38367 of 2025 has not been complied with, the present contempt petition has been filed.

Aggrieved by the belated payment of the retirement benefits, the petitioner preferred W.P.No.38367 of 2025 seeking the following prayer: "to issue a Writ of Mandamus, directing the 1st respondent to forthwith disburse the interest amount at the rate of 12% for the delayed payment of petitioner's retirement benefits by considering the petitioner's representation dated 15.09.2025" 3.

When the writ petition came up for hearing, this Court, after hearing the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents, passed the order directing the first respondent therein to pay interest at the rate of 6% per annum for the belated payment of retirement benefits, in favour of the petitioner, within a period of twelve weeks from the date of receipt of a copy of the order and this Court also made it clear that if the amount is not paid within the time frame fixed by this Court, it will fetch interest at the rate of 9% per annum from the date on which the amount became due and payable till the date of actual realisation.

Alleging non-compliance of the aforesaid order, the present contempt petition has been filed.

The learned Standing Counsel appearing for the respondent submitted that the certified copy of the order dated 14.10.2025 passed in W.P.No.38367 of 2025 was received by the respondent on 22.01.2026 and within twelve weeks from the date of receipt of a copy of the order, the amounts were settled and the period of twelve weeks ended on 06.04.2026. Even prior to 06.04.2026, the order of this Court has been duly complied with by making payments to the petitioner on 13.03.2026 and 27.03.2026 calculating the interest at the rate of 6% per annum.
