O R D E R
The present Writ Petition has been filed challenging the transfer order issued by the 2nd respondent in favour of the 4th respondent.
2. The petitioner was initially appointed as Part-Time Lecturer at NonEngineering Department (Chemistry) by the 3rd Respondent on 06.12.2013 and continued in the said capacity till 14.10.2019. He is presently working as a FullTime Consolidated Lecturer, on contract basis from 09.12.2019 to till date. Whileso, the 4th respondent was transferred in the place of the petitioner by impugned order dated 14.02.2024 and the petitioner was terminated from service. Aggrieved by the said order of transfer, the present Writ Petition has been filed.

Learned counsel appearing for the petitioner submitted that the impugned order of transfer is arbitrary and illegal as no opportunity of hearing was given to the petitioner before passing the same thereby violating the principles of natural justice. Accordingly, he prayed for appropriate orders. 2/4

Per Contra, learned Additional Government Pleader appearing for respondents 1 & 2 submitted that the petitioner is not a permanent employee but only a contract employee and that upon completion of contract period his services would automatically come to an end and in terms of the undertaking given by him. He further submitted that the 4th respondent was transferred to the printing institution and such transfer was effected purely on the administrative ground. If at all the petitioner is aggrieved by the said order of transfer, it is open to him to challenge the same in the manner known to law.
5. Heard both sides and perused the materials available on record.
6. Admittedly, the petitioner was a contractual employee. The alleged transfer is stated to have been on administrative ground. It is well settled that unless the transfer order is vitiated by malafides, statutory violation or lack of jurisdiction, the same cannot be interfered with. However, no material has been placed by the petitioner before this Court to establish that the transfer order suffers from vice of illegality. In the absence of any such material, the order of transfer which is under challenge does not warrant any interference. 3/4

7. For the reasons aforesaid, this Court finds no merits in the Writ Petition and the same is liable to dismissed. Accordingly, the Writ Petition stands dismissed. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
