Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the first respondent to issue quality seeds, quality pesticides, adhering to the standard manure etc., through the outlets maintained by the second respondent through out the Union Territory of Puducherry to the deserving small and medium agriculturists in the Union Territory of Puducherry.

2. The petitioner seeks for a Mandamus directing the first respondent to issue quality seeds, quality pesticides, adhering to the standard manure etc., through the outlets maintained by the second respondent to the small and medium agriculturists in the Union Territory of Puducherry.

The petitioner claims to be an Agriculturist, having an extent of 5 acres of land, doing agricultural work therein, after obtaining various concessions, subsidies and other benefits offered by the Government through various schemes. The grievance of the petitioner is that the respondent-Government, all of a sudden has taken a decision not to operate the outlets opened by the Puduchery Agro Service and Industries Corporation due to administrative reason, which caused heavy loss and hardship to the small and medium level agriculturists like the petitioner.

Therefore, it is contended that all the agricultural tools like quality seeds, pesticides and other machinery etc., for the purpose of agriculture should be made available through the above said Corporation or through the Department, as was done prior to the formation of the said Corporation. Ventilating such grievance, the petitioner has already approached the respondents by way of representations dated 03.01.2019 and 04.01.2019.

Therefore, it is for the respondents to consider the said representations and pass orders on the same on merits and in accordance with law, as this Court is not expressing any view on the merits of the matter. Accordingly, this writ petition is disposed of only by directing the respondents to consider the representations dated 03.01.2019 and 04.01.2019 made by the petitioner and pass appropriate orders on the same on merits and in accordance with law, within a period of three weeks from the date of receipt of a copy of this order.
