ORDER

The petitioner who was arrested and remanded to judicial custody on 25.01.2026 for the offence punishable under Sections 191(2), 191(3),, 103 r/w 190 of the BNSS, 2023 in Crime No.34 of 2026 registered on the file of respondent police seeks bail.

2. The case of the prosecution is that the petitioner along with other accused consumed liquor and taken the deceased to a lonely place and attacked the deceased with knife. It is alleged that the petitioner has attacked the deceased with beer bottle due to which the deceased died on the spot itself. Hence the case has been registered.

The learned counsel for the petitioner submitted that the petitioner herein has not involved in the crime and without knowing the motive of the co-accused the petitioner has dropped the other accused in the place of occurrence. He further submitted that the petitioner is in Judicial custody from 25.01.2026 and is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate reiterated the prosecution case and submitted that CCTV footage reveals that the petitioner has attacked the deceased with beer bottle. He further submitted that only due to previous enmity the occurrence has taken place and all the accused in this case have been arrested and they are still under custody. Hence, he opposed to grant bail to the petitioner.

5. Considering the manner in which the occurrence has taken place and the specific overt act against the petitioner and all the other accused persons were still in custody, this Court is not inclined to grant bail to the petitioner.
