The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under sections 294(b), 324, 392 and 506(ii) IPC in Crime No.254 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused robbed a cell phone and money purse from the defacto complainant and assaulted him with knife and flew away from the spot. Hence the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner. 4.The learned Government Advocate(Crl.Side) would submit that the petitioner is a habitual offender, against him, there are five previous cases. mpa the accused on the same day and the custodial interrogation of the petitioner is very much required for the purpose of identification. Hence, he opposed to grant bail to the petitioner.
5.Taking into consideration, the habituality of the petitioner and also he is involved in five previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
