(Judgment of the Court was made by P.VELMURUGAN, J.) Today, when the matter is called for hearing, the learned counsel for the appellant represented that he filed a memo stating that the main suit itself has been 2 / 4

dismissed a settled out of court vide judgment dated 18.11.2021 and hence nothing survives in this appeal and same may be dismissed as infructuous. This appeal is arising out of the interlocutory order passed in A.No.1108 of 2020 in C.S.No.721 of 2019 dated 03.12.2020. Now the main suit in C.S.No.721 of 2019 itself has been dismissed as settled out of Court vide judge dated 18.11.2021 at the instance of the learned counsel for the appellant. Hence nothing survives in this appeal for further adjudication. Therefore recording the said memo dated 02.04.2024 and in view of the judgment dated 18.11.2021 in C.S.No.721 of 2019, this appeal shall stand dismissed as infructuous.
