Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, directing the 1st respondent to consider and pass orders on the appeal preferred by the petitioner dated 1.2.2014 fixing outer time limit. For Petitioner : Mr.C.Selvaraju, Sr. Counsel Assisted by Mr.P.Ganesan For Respondents : Mr.Rm.Muthukumar Government Advocate.

By consent, the writ petition is taken up for final disposal.

2. The petitioner claims that she has purchased two plots bearing Nos.39 and 40 in R.S.No.256/2, admeasuring to an extent of 3600 sq.ft., in Pattanur Panchayat, Vanur Panchayat Union, during the year 1998 and the said property is in her possession and enjoyment.

The petitioner would further state that some encroachments have been made on the southern zone with the connivance of the local body authorities and in this regard she submitted representation to the respondent for removal of encroachments and since, no action was taken, W.P.No.17210 of 2013 was filed and this Court vide order dated 31.10.2013, directed the concerned authority to dispose of the representation and in compliance of the order, the 2nd respondent has disposed of the representation stating that it has rejected the prayer made by the petitioner and aggrieved by the same, she filed an appeal to the 1st respondent on 01.02.2014 and since, no progress took place in the https://hcservices.ecourts.gov.in/hcservices/

appeal, came forward to file this writ petition.

3. Heard the submissions the learned Senior counsel appearing for the petitioner and Mr.Rm.Muthukumar, learned Government Advocate, who accepts notice for the respondents.

4. Taking into consideration the limited scope of the prayer sought for by the petitioner and without going into the merits of the appeal, this Court, directs the 1st respondent to consider the appeal dated 01.02.2014, preferred by the petitioner, on merits and in accordance with law and pass orders as expeditiously as possible and not later than eight weeks from the date of receipt of a copy of this order and inform the decision taken, to the petitioner.
