Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of Habeas Corpus, directing the first respondent to produce life convict prisoner no.2724 namely P.Kumar before this Court and let him parole for 12 days to do spiritual everyday to his mother namely Tmt.Gnambal, W/o.Late Poongavanam.

ORDER

(Order of the Court was made by C.T.SELVAM, J.) Petitioner / Wife of the detenu-P.Kumar, a convict prisoner, has filed the present petition seeking leave for 12 days for attending the last spiritual ceremony on 15.08.2018.

2. We have heard Mr.P.Krishnan, learned counsel for petitioner as also Mr.M.Mohamed Riyaz, learned Additional Public Prosecutor for respondents.

3. We also perused the affidavit of the petitioner as also counter affidavit filed by first respondent. The petitioner had earlier been granted leave for one day to attend the funeral of his mother and that leave now is sought towards https://hcservices.ecourts.gov.in/hcservices/

attending ceremonies related thereto.

4. Accordingly, we grant emergency leave for a period of six(6) days commencing from 13.08.2018 (Monday) at 10.00.a.m. till 5.00 p.m. on 18.08.2018 to the detenu viz., P.Kumar, life convict, who is now confined in the Central Prison, Vellore.

5. The Superintendent of Central Prison, Vellore, is hereby directed to release the detenu, viz., Mr.P.Kumar S/o Poongavanam, aged about 36 years, on production of this order. It is made clear that the detenu shall report and surrender before the Superintendent, Central Prison, Vellore, by 5.00.p.m on 18.08.2018 without fail.

6. Registry is directed to forward a copy of this order to Superintendent, Central Prison, Vellore, by Fax.

7. With the above direction, this Habeas Corpus Petition shall stand closed.
